Justin Tse offers some very astute observations on the Supreme Court decision here. By specifying that the decision only applies to “closely held” corporations, the Court attempts to restrict its judgement to the narrow border of public and private; but this case, above and beyond the particulars of the suit,  reveals that this distinction is coming apart in the current absence of any real principle by which it might be drawn.
